Agreement to Terms

By accessing or using shopsunshineusa.com (the "Site") or placing an order with Sun Shine Lights LLC ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you must not use the Site or place an order. We reserve the right to modify these Terms at any time without prior notice — continued use of the Site constitutes acceptance of any changes.

Products & Pricing

We reserve the right to modify, discontinue, or limit availability of any product at any time without notice. All prices are listed in US dollars and are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any order placed at the incorrect price, regardless of whether the order was confirmed or payment was processed. We will notify you of such cancellations and issue a full refund if charged.

Order Acceptance

Placing an order does not constitute a binding contract until we have accepted and confirmed it. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to: suspected fraud, inaccurate pricing, product unavailability, or concerns about the shipping address. If an order is cancelled after payment, a full refund will be issued to the original payment method.

Payment

Payment is due in full at the time of checkout unless you have an approved net-30 contractor account. We accept major credit and debit cards through Shopify Payments (Stripe). By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full order amount including applicable taxes and shipping fees.

Shipping & Delivery

We aim to ship orders within 1–2 business days of confirmed payment. Estimated delivery times are provided as a courtesy and are not guaranteed. Sun Shine Lights LLC is not responsible for delays caused by carriers, weather, customs, or other circumstances outside our control. Risk of loss and title for products pass to you upon delivery to the carrier.

Installation Responsibility

All electrical fixtures must be installed by a licensed and qualified electrician in accordance with applicable local building codes, the National Electrical Code (NEC), and all manufacturer instructions. Sun Shine Lights LLC is not responsible for any damage, injury, fire, electrical failure, or other consequence resulting from improper installation, DIY installation without proper qualifications, use of incompatible components, or operation outside of rated specifications. By purchasing our products, you accept full responsibility for ensuring proper and code-compliant installation.

Limitation of Liability

To the maximum extent permitted by applicable law, Sun Shine Lights LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our products or Site, including but not limited to: property damage, personal injury, lost profits, or data loss — even if we have been advised of the possibility of such damages. Our total liability in any matter arising out of or related to these Terms shall not exceed the amount you paid for the specific product giving rise to the claim.

Disclaimer of Warranties

Except for the express 5-year limited warranty stated in our product listings, all products and Site content are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Intellectual Property

All content on the Site, including text, images, logos, product descriptions, and design, is the property of Sun Shine Lights LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from the Site without our prior written permission.

Prohibited Uses

You agree not to use the Site or our products for any unlawful purpose; to resell products purchased at retail prices without prior written authorization; to submit false or fraudulent orders; to interfere with or disrupt the Site or its infrastructure; or to attempt to gain unauthorized access to any part of the Site.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts. Before initiating any legal proceeding, you agree to contact us at contact@shopsunshineusa.com to attempt informal resolution.

Indemnification

You agree to indemnify, defend, and hold harmless Sun Shine Lights LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your purchase or use of our products, your violation of these Terms, or your violation of any third-party rights.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Sun Shine Lights LLC regarding the subject matter herein and supersede all prior agreements, representations, and understandings.
